The globalization of the economy in the current phase of capitalism led to break with thesocial protection mechanisms. Mechanisms built-throat competition with adverse effects onsocial inclusion policies. The various reforms guided by neoliberal principles guided thecontempt for international human rights treaties. This process spanned a political and legal.The present study intends to examine the parameters characterizing theinternational normative social welfare policy as a human right and also aims to propose legal arms able to give you effective. The study is the analysis of international documents and the comparative examination of the jurisprudence of the Supreme Courts ofMercosur member countries.
