In this paper, we will develop the implications that the politics of enjoyment’s own categories bring to the legal field, as it has been exposed by the Slovenian philosopher Slavoj Zizek. Initially, we will discuss the transit in his theory, from the logic of desire to the logic of the drive, as a tool to define the political dynamics in modern society, in order to, at last, identify zizekian theory’s main characteristics that can be preached in the study of law, understanding law itself as the result of the discursive flow inside of the social tissue.
