Inclusive Forms of Access to Justice for Vulnerable Groups

Several international treaties have incorporated an inclusive approach to access to justice, when considering the barriers that different vulnerable groups encounter to access to justice. This is the case for the Convention on the Elimination of all Forms of Discrimination Against Women and the Convention on the Rights of the Child. These regulations helped states to understand how to adjust the justice system and the domestic laws to ensure access to justice for women victims of gender discrimination and children. This study describes the importance of inclusive access to justice, and how international law has contributed to its understanding. Later, it brings examples from Argentina to show how domestic law was adjusted to the new standards of inclusive access to justice. The paper concludes with empirical evidence on how women victims of domestic violence and adolescents experienced access to justice.
